Terms and conditions of use
1. DEFINITION AND OBJECT OF THE CONTRACT
1.1 - This "contract" is a distance contract pursuant to art. 50 et seq. Of Legislative Decree 6 September 2005, n. 206 ("Consumer Code"). The Contract concerns the sale of movable goods between Armeria Regina di Salvador Francesco S.R.L., with registered office in Conegliano (TV) – Via Manin 49 - 31015, VAT no. and C.F. 00604170266, Company Reg. TV 9704, R.E.A. number TV-129680 ("Armeria Regina") and the consumer (the "Customer"). The Contract is concluded directly through the acceptance by Armeria Regina of a purchase proposal issued by the Customer by telephone, via the internet, on the website www.armeriaregina.it (the "Site") and/or through other remote sales systems of Armeria Regina, on the basis of the methods described in the following article 3.
1.2 - These general conditions of sale ("General Conditions") and, in particular, the information referred to in art. 52 of the Consumer Code, as provided by Armeria Regina, repeated on the telephone to the Customer and reported on the Site, will remain valid and effective until they are modified and/or integrated by Armeria Regina. Any changes and/or additions to the General Conditions will be effective from the date on which they are communicated to the public and will apply to sales made from said date. The latest updated version of the General Conditions is the one available on the Site.
2. PRICES
2.1 - The sales prices of the products illustrated on the Site and/or through any other remote sales systems of Armeria Regina include VAT. and any other tax.
Delivery costs are indicated on the Site and/or through any other remote sales systems of Armeria Regina and, in the case of a telephone order, repeated to the Customer by the Armeria Regina operator.
3. PURCHASE AND PAYMENT METHODS
3.1 - The Contract by telephone is concluded by communicating to the Customer (who has contacted Armeria Regina by telephone and formulated, on that occasion, a purchase proposal also providing the operator with the data necessary for the registration procedure of his name, the purchase order and the chosen payment method) that the proposal is accepted.
3.2 - In the case of purchase proposals sent via the Site, the Customer will receive a summary email from Armeria Regina, informing them that their purchase proposal is being processed and will be considered accepted, unless otherwise communicated by email or telephone sent by Armeria Regina within 3 (three) working days from receipt of the summary email. Once this deadline has elapsed, the Internet Contract is to be considered perfected.
3.3 - The Customer will be allowed to choose one of the following payment methods:
3.3.1 - in contrassegno per contanti, da effettuarsi al corriere che consegna il prodotto/i;
3.3.2 - by advance bank transfer, made by the Customer at the time of ordering by sending a copy of the bank transfer to Armeria Regina via fax to 0438 455882 or via email to ordini@armeriaregina.it, which contains the C.R.O. number, beneficiary value date, details of the orderer and reason for the transfer. This bank transfer will be considered valid only when the amount paid has actually been credited to the current account in the name of Armeria Regina, the coordinates below:

3.3.3 - by credit card; The payment made by CREDIT CARD is not automatically collected at the end of the transaction, but after verification by Armeria Regina of the availability to process the entire order. Transactions take place directly on the servers ............ data passage takes place via 128 Bit SSL3 encryption. Any changes to the order or cancellations of the same, with the consequent modification and/or cancellation of the payment by credit card, can be accepted by Armeria Regina within 3 hours of placing the order or before the order has been processed with the wording "FULFILLED" in the field indicating the status of the order within the reserved area accessible only to users registered on the website www.armeriaregina.it.
The customer's written communication must take place via e-mail or fax.
3.3.4 - payment in cash at the Armeria Regina headquarters in via Manin 49, Conegliano (TV), Italy by selecting the "PICK UP IN LOCATION" option. This payment method cancels the order if it is not collected and/or paid within 7 days from the order date.
4. DELIVERY OF PRODUCTS - TIMELINES - COMPLAINTS
4.1 - Shipping costs are automatically calculated based on the weight/volume and number of packages by an automated calculation system which will provide the cost estimate at the end of the order before sending it to Armeria Regina. This calculation of the sum is not entirely binding as other factors may arise such as additional costs for reaching difficult locations, for delivery to floors, for delivery to large distribution centres, for delivery by appointment or for calculation errors in the computerized system. The automatic sending of the order confirmation is not in fact a confirmation of the actual shipping cost.
4.2 – Armeria Regina delivers the products to the address indicated by the Customer within a maximum of 30 (thirty) days from the conclusion of the Contract.
4.3 - The delivery times indicated when selecting the shipping cost (also express and express guaranteed shipping) are to be considered indicative and not contractually binding as unforeseeable factors may arise at the time of stipulation of the contract with the customer and/or at the time of stipulation of the contract with the affiliated shippers.
4.4 - Any complaint can be forwarded to the following address: Armeria Regina di Salvador Francesco S.R.L., Via Manin 49, 31015, Conegliano (TV), Italy.
5. PRODUCT AVAILABILITY
5.1 – Armeria Regina accepts customer orders within the limits of the quantities of products actually existing in stock. Therefore, Armeria Regina's acceptance of the purchase proposal forwarded by the Customer is subject to the availability of the products in stock. Armeria Regina undertakes to promptly notify the Customer of any unforeseeable stock outs due to excess demand or other causes. Availability is indicated in each product sheet by a round symbol in red = not available, yellow = good availability, green = excellent availability. These data are automatically updated every 10 minutes unless there are complications with the telephone line. The availability visible on the website www.armeriaregina.it in the product sheet is not binding on the actual presence of the product in stock.
In the final part of the order, the customer will be asked to specify whether he wishes to receive the products available in stock and at a later time those that Armeria Regina will have to procure, or whether he wishes to receive the shipment as soon as it is complete with all the products ordered.
6. WARRANTIES AND ASSISTANCE
6.1 - For products purchased by the Customer, the rules regarding guarantees and assistance relating to the sale of consumer goods are applicable to Armeria Regina. In any case, to use the warranty service it is necessary to fill in the assistance form which can be downloaded from the following link, following the instructions in detail.
6.2 - The customer will not be able to take advantage of the warranty in cases where the product has been modified and/or tampered with, does not have all the characteristics of the original product, has obvious signs of improper use (such as empty shooting without an arrow for bows/crossbows) and excessive wear compared to normal use of the product and the addition of accessories that may have caused stress to the product. In any case, the guarantee is intended to be used only by the first owner of the product.
6.3 - Shipping costs, unless otherwise agreed by the parties, are borne by the customer.
7. CUSTOMER OBLIGATIONS
7.1 - The Customer declares and guarantees:
(I) to be a consumer in accordance with the provisions of the art. 3 of the Consumer Code;
(II) to be of age;
(III) that the data provided by the same for the execution of the Contract are correct and truthful.8. RIGHT OF WITHDRAWAL
8.1 - The Customer has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within 10 days of receiving the products (as per DLT N 158 of 05/22/1999). The Customer may exercise the right of withdrawal, within the aforementioned deadline, by expressing it by telephone or by means of a written communication at the Armeria Regina headquarters referred to in the art. 4, to be sent by registered letter with acknowledgment of receipt or by telegram, e-mail or fax.
8.2 - The Customer who intends to exercise the right of withdrawal must return the products to the address indicated on the invoice within 10 days of receiving the products. Pursuant to article 55, second paragraph, of the Consumer Code, the Customer will not have the right of withdrawal in the following cases:
supply of products "sealed" and opened by the customer (for example DVDs, books, periodical magazines);
supply of packaged products which are not returned with the original packaging or with the original packaging damaged; the right of withdrawal can in fact be regularly exercised if the product is returned intact in its original packaging.
supply of products made to measure or personalized, or which by their very nature cannot be returned or risk deteriorating or expiring rapidly.
8.3 - The costs of returning the products are borne by the Customer. Armeria Regina will return, within 30 days from the date of receipt of the products by the Customer:
(I) in case of return of the product complete with all its parts and functions, Armeria Regina will return at the customer's discretion the price of the product paid by the Customer excluding costs of additional services, less 10% as storage cost or a product chosen by the customer whose value corresponds to that to be refunded; or
(II) if the product returned by the Customer has been consumed in an appreciable manner and/or such as to significantly diminish its value, Armeria Regina will only return the part of the price equivalent to the product actually received.
9. COMPETENT COURT
9.1 - The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and violation of the Contract will fall under the jurisdiction of the Court of Treviso.
10. NOTE
10.1 - These General Conditions were conceived in Italian. The Italian version, therefore, has prevailing weight and is the only one to be considered binding. The English text must be treated as a courtesy translation of the Italian text.
